Service Description

ultrai.ae provides managed services, offering maintenance and support services exclusively for customers using only WordPress or WooCommerce or Shopify websites. This includes all services displayed on ultrai.ae or negotiated privately to each client. ultrai.ae reserves the right to suspend or discontinue the availability of any service at any time at its sole discretion and with prior notice.

Using our Services

You must follow any policies made available to you within the Services. Don’t misuse our Services. For example, don’t interfere with our Services or try to access them using a method other than the interface and the instructions that we provide. You may use our Services only as permitted by law, including applicable export and re-export control laws and regulations. We may suspend or stop providing our Services to you if you do not comply with our terms or policies or if we notice / suspect misconduct. Using our Services does not give you ownership of any intellectual property rights in our Services or the content you access. You may not use content from our Services unless you obtain written permission from us.

Your Content and our Services

Some of our Services allow you to upload, submit, store, send or receive content. You retain ownership of any intellectual property rights that you hold in that content. In short, what belongs to you stays yours. When you upload, submit, store, send or receive content to or through our Services, you give ultrai.ae (and those we work with) a worldwide license to use, store, communicate. The rights you grant in this license are for the limited purpose of operating, promoting, and improving our Services, and to develop new ones. This license never continues if you stop using our Services.

Modifying or Terminating our Services

We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time. If we discontinue a Service, we will give you reasonable 30 day advance notice and a chance to get information out of that Service.

Authorization

You are engaging ultrai.ae, as an independent contractor to perform work as described in the service(s) you have purchased. To perform these tasks access is required for your website and hosting account. By purchasing a service via ultrai.ae you give the authorization to access and modify the directories, files and database of your website and hosting account.

Copyright Law

ultrai.ae takes no responsibility for your legal interests, therefore it is the client’s responsibility to ensure that information, logos and images comply with copyright laws and you have permission to publish your selected information.

Limitation Of Liability

In no event shall ultrai.ae be legally liable under contract, tort, strict liability, negligence or other legal theory with respect to the website, any services provided or purchased, for any lost profits or special, indirect, incidental, punitive, or consequential damages of any kind whatsoever.

Support Requests

Support requests must be raised through the correct channels, and directly relate to your purchased WordPress service(s). Order of ticket resolving: first in – first resolved, from the segments of customers: first the special SLA accounts, then recurrent accounts and then the freemium accounts. Service Level Agreements entitles you to receive special care and top priority support before recurrent and freemium customers. Recurrent monthly services entitle you to receive priority support from freemium customers. Support requests must directly relate to the website associated with the client’s account and are responded to within approx 1~4 hours, usually much less.

WP, Woo, plugins & theme updates

All updates are completed within 7 days of release, with priority given to security releases. We offer up to an hour of dedicated upgrade support should there be any issues. If we can’t fix it within that time, we will restore the website back-up, and contact the client with recommendations.

Backup Services

Site owners must note that daily-weekly-monthly and/or different backup types will increase their website’s bandwidth usage or storage space, and may incur additional costs with their hosting providers. Customers agree, that only one of the last two backups successfully generated will be kept and used as a reliable solution to restore a website if needed or requested by the owner.

ON-SITE backup services

Customers opting for ON-SITE back-up must note, that daily-weekly-monthly differential backup will increase the storage space, and may incur additional costs with their hosting providers. Site owners using “ON-SITE back-up” as a backup solution must note, that ultrai.ae does not guarantee, that the file(s) stored by 3rd party solutions will not be corrupted nor that they will work as expected, nor that they will not contain infected files or data loss. These all remain to the 3rd party solution providers sole responsibility and liability.

Backup via dedicated providers

Customers opting for dedicated providers (3rd party, cloud storage solutions) must note, that daily-weekly-monthly different backups will increase the storage space, and may incur additional costs with their hosting providers. Site owners using “Dedicated providers” as a backup solution must note, that ultrai.ae does not guarantee, that the file(s) stored by 3rd party solutions will not be corrupted nor that they will work as expected, nor that they will not contain infected files or data loss. These all remain to the 3rd party solution providers sole responsibility and liability.

Cancellation & Refunds

Cancellation of any monthly recurring Services can occur at any time after your first 1 month (30 days) of payment. No refunds are available after your purchased package or service has been started unless otherwise specified in any authorized promotional materials and marketing campaigns.

Promotions & Advertising

Promotional offers for ultrai.ae or partners may be sent together with email reports. ultrai.ae also reserves the rights to display third party advertisements on the website. This website contains some affiliate links to businesses we have used and would recommend.

Pricing & payments

All prices appearing on this site are subject to change without notice. If pricing changes affect subscriptions or ongoing charges clients will be notified via their nominated email account with a minimum of 1-month notice. Services paid in advance will not be affected by any pricing adjustments and remain valid till paid timeline expires.

Service refusal

ultrai.ae reserves the right to refuse service to any website or individual. We do not accept websites that contain offensive, pornographic, hateful or malicious or illegal content. Unreasonable requests (other than our advertised services; other than a WordPress website; but not limited to these examples) or language barriers are also void our liability.

UNIQUE prices

ultrai.ae reserves its right to create discounted, promotional, time-bound, special or unique price packages; other, then the standard services. These promotional offers are valid only for new customers. Ordering service(s) with a recurrent payment, via a special promotion, allows securement of service/license providing, paid up-front for a longer period but limited to a maximum of 12 months per owner. Time-related promotions are always on GMT+2, standard Estonian time. Limited number promotions are subject to payment confirmations and availability is displayed real-time (server-to-server communication delay may occur). This means, that you can finish an order, go successfully through the checkout page, but fail at card processing, as the available number of promotions was sold out. We always honour paid confirmation orders, no matter the limited availability.

Business use of our Services

If you are using our Services on behalf of a business, that business accepts these terms. It will hold harmless and indemnify ultrai.ae and its affiliates, officers, agents, and employees from any claim, suit or action arising from or related to the use of the Services or violation of these terms, including any liability or expense arising from claims, losses, damages, suits, judgments, litigation costs and attorneys’ fees.

About these Terms

We may modify these terms or any additional terms that apply to a new Service to. You should look at the terms regularly. We’ll post notice of modifications to these terms on this page. We’ll post notice of modified additional terms in the applicable Services. Changes will not apply retroactively and will become effective no sooner than fifteen days after they are posted. However, changes addressing new functions for a Service; or changes made for legal reasons will be effective immediately. If you do not agree to the modified terms for our Services, you should discontinue your use of those Services. If there is a conflict between these terms and the additional terms, the additional terms will control for that conflict. These terms control the relationship between ultrai.ae and you. They do not create any third party beneficiary rights. If you do not comply with these terms, and we don’t take action right away, this doesn’t mean that we are giving up any rights that we may have (such as taking action in the future). If it turns out that a particular term is not technically enforceable, this will not reflect on the remaining other terms.
